On February 28, 2008, a bill (A2403) was introduced that would repeal New Jersey’s recently enacted Plant Closing Law, which requires certain employers to provide pre-notification of not less than 60 days for certain plant closings, transfers and mass layoffs. If passed, this would not affect employers’ obligations under the Federal WARN Act, which would remain in effect.
On a related note, on March 19, 2008, the Commissioner of the New Jersey Department of Labor and Workforce Development published its sample notification form to be used by employers to comply with the state’s Plant Closing Law. It is available for download from the Department of Labor’s website.
