Bensy is a seasoned litigator who represents life, health, and disability insurance companies and benefit plans in ERISA litigation matters in state and federal courts across the country. Bensy also represents employers in all aspects of employment litigation, including cases alleging Title VII discrimination; disability, age and military status discrimination; sexual harassment; retaliation for protected activity; wrongful discharge; wage and hour claims; and FMLA violations; as well as trade secret, breach of contract and other employment and business-related matters.
Bensy has substantial experience appearing before federal and state courts, as well as administrative agencies, including the U.S. Equal Employment Opportunity Commission and the U.S. Merit Systems Protections Board. She has represented employers in the insurance, healthcare, technology, manufacturing, retail, transportation and hospitality industries.
Bensy has taken and defended numerous depositions, and has drafted and argued several motions, including motions for summary judgment and motions to dismiss. She has taken seven cases to trial as the first-chair attorney leading litigation and strategy.
Bensy also advises employers on day-to-day employment matters, including employee benefits, discipline and termination, leaves of absence, wage and hour compliance, employee handbooks and preventive policies and practices.
