Dara L. DeHaven

Dara DeHaven is an advisor and advocate for management. She advises clients in developing, implementing and monitoring employment policies, practices, and preventive maintenance programs to ensure regulatory compliance and to assist in dealing with employment matters before they reach litigation. This practice includes policy design and review, supervisory training, investigation, analysis, and resolution of complex employment situations. This preventive practice is based on substantial experience representing management before the EEOC, NLRB, OFCCP, U.S. Department of Labor, and state and federal courts.

Ms. DeHaven is a frequent speaker to local and national businesses, professional, and civic organizations on labor and employment-related issues. She has been recognized in Chambers USA America’s Leading Lawyers for Business, Best Lawyers in America, Georgia “Super Lawyers”, and Georgia Trend magazine’s “Legal Elite.”

Ms. DeHaven holds a Master’s degree in History and in University Administration and served as an Assistant Dean at Emory University in Atlanta. Ms. DeHaven is active in local and national civic and nonprofit associations and currently serves as a member of the Board of Visitors of the Duke University School of Law.


Ms. DeHaven defends and counsels on a broad range of employment-related issues including, but not limited to the following:

  • Represents federal contractors and subcontractors in affirmative action plan design and preparation, compliance evaluations, and administrative enforcement actions triggered by the United States Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP)
  • Advises clients on preparation of employment agreements and separation agreements, including enforcement of restrictive covenants such as non-compete, non-solicitation, and confidentiality agreements.
  • Prepares, reviews, and updates employee handbooks, policies and procedures to incorporate traditional topics and to address new issues raised by developing technology and the virtual workplace such as social media and telecommuting policies.
  • Counsels national, regional and local companies on compliance, planning and managing employee leave and accommodation issues under the Americans with Disabilities Act and the Family and Medical Leave Act.
  • Provides compliance advice, conducts workplace audits, and represents clients before the U. S. Department of Labor on complex wage and hour issues under the Fair Labor Standards Act.
  • Identifies and offers practical solutions for employment issues in corporate reorganizations, mergers, acquisitions, and reductions-in-force. This practice includes compliance with the Worker Adjustment and Retraining Notification (WARN) Act and the Older Workers Benefits Protection Act.
  • Defends employers against allegations of race, age, gender, sexual harassment, national origin, disability and retaliation claims pending in state and federal court and administrative agencies.
  • Analyzes other workplace issues such as employee discipline and discharge, independent contractor classifications, corporate structure and single entity determinations, joint-employer issues, and workplace torts such as defamation, invasion of privacy, and interference with employment or business relationships.
