Gwendolyn K. Nightengale

Gwen Nightengale advises and represents management on workplace safety and health issues nationwide. She regularly represents mining companies in the coal, metal, stone, sand and gravel industries in enforcement proceedings before Administrative Law Judges of the Federal Mine Safety and Health Review Commission. She litigates formal contests of agency enforcement actions and employment discrimination claims based on safety activity. Gwen advises companies on regulatory compliance, assists mine operators with government accident investigations, special investigations, discrimination investigations, and inspections. She also represents mine operators in conferences with regulatory officials.

Gwen speaks and writes on a variety of workplace safety and health topics. She recently co-authored the “Voluntary Safety and Health Self-Audits” chapter of the third edition of the Occupational Safety and Health Law Handbook (Rowman & Littlefield, 3d ed. 2016).
