Heather Huffman represents employers and supervisory personnel in a variety of employment-related disputes. She has successfully resolved numerous lawsuits, administrative charges, and informal disputes, employing both successful advocacy and skillful negotiation to cost-effectively achieve desired results. Heather has significant experience litigating or otherwise resolving disputes arising under state and federal law including discrimination, harassment, retaliation, wrongful termination in violation of public policy, and employer intentional torts. Heather pursues enforcement of employers' rights in matters involving non-solicitation or non-competition agreements, misappropriation of trade secrets, unfair competition and tortious interference.  Heather also has experience representing employers in ERISA litigation.

Heather advises businesses in a variety of sensitive employment matters. She works closely with her clients to develop policies, strategies and best practices to pursue legitimate business objectives while minimizing exposure to liability. She has experience in conducting and advising businesses conducting workplace investigations and has handled I-9 compliance audits.


Experience

  • Prevailed on summary judgment in numerous single-plaintiff employment cases, representing hospital systems, non-profit entities, family-owned business, and national corporations.
  • Persuaded the judge to exclude punitive damages from consideration and obtained verdict for public relations firm and individual supervisor defendants on sex and age discrimination claims in week-long jury trial.
  • Effectively defended many employers against state and federal administrative charges of discrimination, harassment and retaliation, resulting in findings of no probable cause.
  • Obtained temporary restraining orders against former employees of national staffing company located throughout the United States to enforce non-compete agreements and protect against unfair competition and misappropriation of trade secrets.
  • Successfully argued in the Sixth Circuit Court of Appeals for affirmation of summary judgment decision on an ERISA issue of first impression regarding withdrawal liability.
