Davis focuses his practice on matters of workplace safety and health, and represents clients nationwide in matters arising under federal and state occupational safety and health statutes. He leverages his public sector experience with the federal Occupational Safety and Health Review Commission (OSHRC) to handle workplace safety matters from initial response and investigation, through trial and appeal. His practice includes litigating OSHA-related matters before federal and state agencies and courts, assisting with government investigations, and advising clients on federal and state OSHA compliance. Davis also advocates for employers and industry associations in rulemaking and policy formation on issues of occupational safety and health.
Davis’ practice also includes defending employers in whistleblower and retaliation matters under a broad range of federal statutes, including the Occupational Safety and Health Act (OSHA), the Wendell H. Ford Aviation Investment and Reform Act for the 21st Century (AIR21), the National Transit Systems Security Act (NTSSA), and the Surface Transportation Assistance Act (STAA). He is also experienced in defending employers against a variety of employment related claims, including claims of discrimination and wrongful termination.
Davis represents and advises employers in a variety of industries, including manufacturing, construction, energy, healthcare, retail, and maritime.
Prior to joining Ogletree Deakins, Davis served as an Attorney-Advisor in the U.S. Occupational Safety and Health Review Commission’s Office of General Counsel where he advised presidentially-appointed Commissioners on the disposition of pending cases at the review level. His previous experience includes serving as a law fellow for the Legal Services Corporation and a judicial law clerk for the Honorable Donald B. Hocker of the South Carolina Circuit Court.
