Joshua A. Brand

Josh represents employers in the full spectrum of labor and employment matters. Josh regularly defends employers before federal, state, and administrative tribunals against claims of discrimination, harassment, and retaliation.  Josh has prosecuted and defended numerous trade secret and restrictive covenant cases on behalf of employers.  Josh’s experience also includes a focus on traditional labor law, including representing employers before the National Labor Relations Board (“NLRB”) in union representation and unfair labor practice cases, as well as extensive experience handling grievance arbitrations before the American Arbitration Association.  Finally, Josh has experience litigating federal and state wage and hour cases, including defending employers in hybrid class/collective action lawsuits brought pursuant to the federal Fair Labor Standards Act (“FLSA”) and state law, and, handling administrative proceedings with the Pennsylvania Department of Labor and Industry and New Jersey Department of Labor and Workforce Development.

While Josh vigorously defends his clients in litigation, he also works with employers to avoid or prevent litigation where possible.  To that end, Josh regularly provides advice to clients on personnel decisions; drafts and reviews employee handbooks and other personnel policies; and provides training to employees and supervisors.

Josh began his career as an Assistant City Solicitor in the City of Philadelphia Law Department in its Labor and Employment Unit, where he defended the City and its agencies in both employment and labor matters.
