Mr. Zwetsch combines a diverse background in employment law with prior human resource management experience to defend and counsel employers facing employment litigation, complex and changing employment laws, and countless workplace issues. His trial experience includes jury trials, bench trials, administrative hearings, arbitrations, and evidentiary proceedings. As a generalist and litigator he handles all types of employment actions including trade secret, solicitation, non-compete, whistleblower, sexual harassment, false claim act, ERISA, ADA, computer fraud and abuse act, state law tort claims, and FLSA actions (single/collective actions and state law class actions). He also responds to government investigations, including EEOC, NLRB, DOJ, OSHA, and state agencies. Mr. Zwetsch often counsels employers on workplace issues including violence/threats, staff reductions, discipline and discharge, policy changes, employee theft and fraud, wage and hour compliance, FMLA/ADA/USERRA, and acquisitions. Mr. Zwetsch also handles third-party indemnification actions, Title III ADA lawsuits, and ERISA recovery and collection actions.
After studying industrial and labor relations as an undergraduate Mr. Zwetsch enjoyed a career in human resources working in several industries. He returned to law school at age 30 to fulfill a lifelong dream. In 2001, he was among the first group of lawyers to be certified by The Florida Bar as a specialist in labor and employment law. Before joining Ogletree Deakins, Mr. Zwetsch was a shareholder at a prestigious Florida law firm for 17 years. He has been rated at the highest level by peers and lawyer rating organizations including Best Lawyers in America and Martindale-Hubbell (AV rated).
