Kimberly Carter has extensive experience representing clients in a wide array of employment matters including defending management against claims of wage and hour violations, discrimination, harassment and retaliation, invasion of privacy, wrongful termination and other employment-related torts and liabilities. Ms. Carter has defended employers against charges and lawsuits brought under Title VII of the Civil Rights Act of 1964, the ADA, the FMLA and other state and federal laws. Ms. Carter also counsels clients on employment-related issues ranging from disability accommodations, protected leaves of absence, personnel policies, employee handbooks, and employee discipline and termination.


Experience

Ms. Carter’s work includes:

  • Representing large international industrial materials company against claims of national origin discrimination, harassment, retaliation and wrongful termination
  • Defending major hardware and furniture manufacturer against claims of disability discrimination and wrongful termination
  • Representing major logistics and transportation services company in large class action lawsuit alleging numerous wage and hour violations
  • Assisting international industrial materials company in drafting employee and HR handbooks, with particular attention to policies and procedures regarding classification of exempt and non-exempt employees, prohibiting unlawful harassment, Family and Medical Leave Act policies, and disciplinary procedure policies
  • Preparing domestic and international wage and hour law surveys for major luxury brand and retailer
  • Counseling large digital entertainment company on various employment-related issues in order to minimize its exposure to employment litigation
  • Defending major food supplier against California Labor Code Section 132a claims brought by former employees before the Worker’s Compensation Appeals Board
