Kyle is a senior attorney in the firm’s Richmond office. He focuses his practice on employment litigation and employment counseling, and advises employers on a broad spectrum of workplace issues and legal considerations. Kyle has experience defending employers within a wide range of labor and employment topics, including: Title VII of the Civil Rights Act of 1964; the Americans with Disabilities Act (ADA); Fair Labor Standards Act (FLSA); the Age Discrimination in Employment Act (ADEA); The Occupational Safety and Health Act of 1970 (OSHA); The Uniformed Services Employment and Reemployment Rights Act (USERRA); grievances under the Virginia Personnel Act; breach of employment contracts; breach of restrictive covenants; wrongful termination; workers compensation; and other general employment litigation in both federal and state courts.
Kyle assists his clients in managing administrative agency investigations, including disparate impact claims involving unequal pay, background checking, promotion, hiring and pre-employment drug testing, occupational safety and health, and reasonable accommodation processes, among many others. He also counsels employers concerning ADA compliance, OSHA compliance, personnel policies and workplace issues, including leave, benefits, severance, wage and hour obligations, employee discipline, affirmative action plans and employment discrimination matters.
Kyle serves as an advocate of the Commonwealth of Virginia. His experience includes representing higher education clients in a variety of litigation matters, such as defense of claims brought under Title VII, ADEA, and USERRA, wrongful discharge, breach of contract, and other forms of leave, wage and hour disputes, individual and official capacity claims under 42 U.S.C. §§ 1983, and related state law tort claims. His work includes representation of the Commonwealth’s Agencies in grievance proceedings.
Kyle represents clients before the government of the City of Richmond, Virginia. With his experience as a Richmond City Attorney and his familiarity with municipal government and Richmond politics, Kyle has successfully assisted clients in drafting ordinances and navigating them through City Council for approval. Kyle’s commitment to public service matters in his community serves as a tremendous asset. His public interest work is significant and varied, and includes: serving as President of the Museum District Association, President of the Richmond Bar Association Young Lawyers Section, and as a member of the Advisory Council of Legal Aid Justice Center, and former member of the Board of Young Professionals of Greater Richmond SCAN.
Kyle graduated from the University of Virginia with a concentration in Philosophy and The College of William and Mary School of Law, where he served as a member of the Moot Court Board, and was a member of the William and Mary Bill of Rights Journal. Prior to joining the firm, Kyle worked as a City Attorney for the City of Richmond, Virginia where he defended the city and its officers in a variety of tort matters. Kyle transferred his municipal experience to a civil litigation firm in Richmond, representing clients throughout the commonwealth in employment matters, tort defense, and business and commercial litigation. As a law student, Kyle was a summer clerk for U.S. Federal District Court Judge Gerald Bruce Lee in the Alexandria Division of the Eastern District of Virginia.
