Matthew Linton advises clients on a broad range of workplace and environmental safety and health issues, employment matters, and government investigations throughout the nation. He routinely handles the legal and crisis response to workplace accidents and fatalities and safety related whistleblower complaints with agencies such as OSHA, MSHA, CSB, DOT, EPA, and others. Linton also crafts risk management strategies to avoid government entanglement with a variety of federal and state agencies.

Matthew has specialized experience handling complex mine safety and health litigation including high stakes proceedings before the Federal Mine Safety and Health Review Commission involving imminent danger orders, fatal accidents, whistleblower complaints, and emergency motions for expedited hearings, among other things. Matthew's knowledge and experience as a former U.S. government attorney helps clients achieve the best possible outcomes when facing complex, high-profile agency enforcement actions. He works persistently to resolve cases before trial, and if necessary, defend complex matters through trial and appeal.


Experience

  • Negotiated complex settlement agreement with OSHA and successfully obtained reductions in classification and penalty involving a near fatal accident.
  • Secured rapid re-opening of multiple underground mines facing imminent danger withdrawal orders from MSHA.
  • Achieved dismissal at the investigative stage of numerous whistleblower complaints under a variety of federal statutes including the Mine Act, OSH Act, STAA, and more.
  • Conducted internal investigation for company facing sexual discrimination claim before the EEOC and successfully obtained dismissal of case at investigative stage.
  • As a government attorney, successfully prosecuted numerous administrative trials before the Federal Mine Safety and Health Review Commission.
