Prior to joining Ogletree Deakins, Schenberg was a partner in the St. Louis office of Husch Blackwell LLP. Schenberg is an experienced litigator with a particular focus on complex litigation including collective actions brought under the Fair Labor Standards Act and the Age Discrimination in Employment Act in addition to employment discrimination and retaliation cases filed against small, medium, and large corporations in jurisdictions throughout the United States. As a litigator, Schenberg works closely with the in-house counsel of national and international companies regarding litigation case budgets, claim investigations, risk analysis, coordination of witnesses, mediation, and litigation strategy.

Schenberg also maintains a comprehensive advice and counsel practice focusing on compliance and risk management for clients in industries such as, pharmaceutical, manufacturing, telecommunications, healthcare, law enforcement, and construction. He advises in-house counsel, corporate executives, and human resources personnel regarding termination decisions, leave issues under the Family and Medical Leave Act (FMLA), wage and hour issues, employee classification, application of the Fair Credit Reporting Act, disability law, workers’ compensation retaliation law, discrimination statutes, restrictive covenants, employee monitoring, drug testing, and other litigation risks. One aspect of Schenberg’s advice and counsel practice includes training for managers on topics including sexual harassment, interviewing, employee discipline and documentation.
Outside of his legal practice, Schenberg is a coveted speaker and presenter on topics such as attorney-client privilege and corporate employees; ethical issues for employment lawyers; interaction of FMLA, ADA, and workers’ compensation; use of social networking sites in hiring process; computer and email policies; drugs and alcohol in the workplace; investigation of harassment claims; federal election laws; pregnancy, maternity, and fertility leave; and the National Labor Relations Act and the non-union employer.
Schenberg earned his J.D., cum laude, from the University of Michigan School of Law in 1993, and an A.B., magna cum laude, from Brown University in 1990.
