Abigail S. Wallach

Shareholder   |   Denver, Chicago

Abbey Wallach represents employers of all sizes on all matters impacting their employees under federal and state law, including compliance with Title VII of the Civil Rights Act, the Americans with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), the Family and Medical Leave Act (FMLA), the Fair Labor Standards Act (FLSA), and the Employee Retirement Income Security Act (ERISA), as well as state laws in Illinois, Montana, and Colorado. Abbey handles all stages of litigation, from investigations; charges of discrimination, harassment and retaliation; through trial in state and federal court. In addition, Abbey has conducted over 30 Title IX and employment law internal investigations for employers and universities.

When not actively litigating, Abbey advises employers to prevent litigation by addressing day-to-day employee issues under state and Federal law. Though Abbey represents a wide variety of clients, she has particular expertise advising in the hospitality, restaurant, retail, and manufacturing industries.

Abbey is also deeply committed to community engagement. She maintains an active pro bono practice and serves as a member of Sarah’s Circle Impact Board in Chicago. Previously, she served on the board of the Rose Andom Center in Denver, managed fundraisers for a Colorado politician’s reelection campaign, mentored a college student through the Law School Yes We Can program, and was a member of the Women’s Foundation of Colorado Empowerment Council.

Abbey received her J.D. from the University of Colorado Law School, where she was a member of the national moot court team and won the Austin W. Scott Best Orator Award in the Rothgerber Moot Court Competition. Abbey was also awarded the Women’s Law Caucus Award by a vote of the law school student body. Abbey received her undergraduate degree, magna cum laude, in History with a minor in Spanish from The College of New Jersey, where she ran NCAA cross country and track and field for four years.

Prior to joining Ogletree Deakins, Abbey practiced at two Denver-based law firms and clerked for Judge Gale Miller on the Colorado Court of Appeals.
