This briefing will walk attendees through the employment life cycle of a foreign national employee— from hiring a foreign national student on an internship, to continuing employment after graduation on an H-1B visa, to identifying viable options to maintain work authorization for those not selected in the annual H-1B lottery, to obtaining a green card. During the session we will provide an overview of the H-1B visa, present best practices and strategies for filing petitions, and review recent regulatory changes that may provide relief to those students not selected in the lottery. We will also outline the elements of a comprehensive capfiling strategy that can be crucial to help companies ensure effective immigration compliance and retain new talent. We will conclude with a discussion of the long-term plan for obtaining a green card (i.e., lawful permanent residence).
