On November 8, 2016, Florida voters approved Amendment 2. The amendment expands the state’s limited medical marijuana program to allow the medical use of marijuana by individuals with specific debilitating conditions or those with conditions for which a physician believes that the benefits of marijuana would outweigh the potential risks. Considering the speed with which marijuana laws have swept the country, the fact that marijuana remains illegal under federal law, and plaintiffs’ attorneys recent efforts in this area of law, it is no surprise that employers are overwhelmed.
