Federal courts and the EEOC are making it increasingly difficult to determine the extent of an employer’s obligations to accommodate employees claiming to have disabilities. Situations previously believed to be settled law have become less certain, such as those related to erratic attendance and working from home. Complicating matters, employees seeking such accommodations often have recently taken FMLA leave or have had workers’ compensation claims. This session will identify several of these situations and propose best practices for evaluating and addressing employees who vaguely identify alleged disabilities and/or the need for accommodation.
