On December 12, 2014, the National Labor Relations Board (NLRB) issued the long-anticipated “ambush election” rules, which govern the procedures for union representation elections. Arguably the most significant regulatory change ever implemented by the NLRB, these new rules make unionizing a workforce faster and easier. When the new rules go into effect on April 14, 2015, they will make it possible for union elections to occur in fewer than 21 days after a union requests a vote. They will also make it more difficult for employers to have disputes over voter eligibility resolved prior to an election, and create onerous new pleading requirements for employers seeking to do so.
