On January 26, 2023, the Occupational Safety and Health Administration (OSHA) announced a significant expansion of its “instance-by-instance” citation policy. The revamped policy, which is scheduled to go into effect in March, will allow OSHA to issue citations for each instance of noncompliance in certain cases the agency identifies as involving “high-gravity” serious violations. This change may lead to the issuance of more citations with significantly increased penalties.
