Beginning on July 1, 2022, New Mexico’s Healthy Workplaces Act (HWA) requires private employers with even one employee working in New Mexico to provide paid sick leave (PSL) to eligible employees. The New Mexico Department of Workforce Solutions (DWS) recently published HWA guidance, in the form of answers to frequently asked questions (FAQs), and regulations to provide guidance and clarity on various issues as the effective date approaches, including the definition of “covered employees”; rules for accrual, use, and carryover of paid sick leave; frontloading; and employee documentation and employer notification requirements.
Several state and local minimum wage rates will increase in the latter half of 2022, with most of these changes effective on July 1, 2022. Increases to minimum wage rates for nonexempt employees and tipped employees in Florida will occur later in the year, on September 30, 2022.
On April 7, 2021, New Mexico Governor Michelle Lujan Grisham signed House Bill 20, enacting the Healthy Workplaces Act (HWA), which will require private employers in New Mexico with at least one employee to provide paid sick leave to employees. The new law becomes effective on July 1, 2022.
On June 7, 2017, Labor Secretary Alexander Acosta announced that the U.S. Department of Labor (DOL) has withdrawn two informal guidance documents on independent contractor misclassification and joint employment, both issued during the Obama administration.
