The New Jersey Department of Labor (NJDOL) recently issued an updated MW-17 Wage Payment poster that all New Jersey employers must conspicuously post in the workplace by July 13, 2010. The new poster is intended to comply with recent amendments to the wage payment law, as reported in the February 2010 issue of the New Jersey eAuthority. (The new poster actually neglects to reference several permitted deductions from employees’ wages. We expect the NJDOL to issue a revised version of MW-17 to correct the omission, but that may not occur prior to the required posting date of July 13, 2010).
The new law also requires that employers personally distribute a hard copy of a NJDOL-prepared notice about the law to all current employees within 30 days after the notice is issued by the NJDOL and to any employees hired thereafter. We have been advised by the NJDOL’s Assistant Director, Wage and Hour Compliance, that the required notice (which is different than MW-17) will take several months to prepare, but that once it is prepared the NJDOL will post it online (starting the 30-day distribution clock).
