In the November 2011 issue of the New Jersey eAuthority, we reported on the NJDOL’s recent issuance of a new six-page notice/poster that employers must distribute to all employees and post conspicuously in accessible locations. Employers were required to start distributing the document to new hires as of November 7, 2011, and to distribute the document to all current employees, and post the notice in accessible locations, by December 7, 2011.

The accompanying regulations specify that, where an employer has an Internet or intranet site for exclusive use by its employees and to which all employees have access, posting of the notice on the employer’s Internet or intranet site will satisfy the conspicuous posting requirement. Similarly, distributing the notice via email satisfies the requirement to provide each employee a written copy of the notification.
