Scott Kelly, a shareholder in the firm’s Birmingham office, has been appointed by the American Bar Association’s Section of Labor and Employment Law to a one-year term as Employer Co-Chair of the Section’s Leadership Development Program. In his role, Kelly will help coordinate leadership training and development to a select group of Section members representing all constituencies of the Section (Union/Employee, Employer, and Government/Neutral). Prior to his appointment, Kelly was selected as a member of the leadership program’s inaugural class.
In his practice, Kelly represents employers in employment-related litigation on federal, state and local levels before court and administrative agencies regarding claims concerning discrimination, harassment, wrongful discharge, and wage and hour violations (including collective actions). In addition, he regularly provides counseling to employers on matters of employee discipline and termination, enforcement and implementation of employment policies, and workplace investigations. A significant amount of Kelly’s practice is devoted to representing federal contractors and sub-contractors in compliance evaluations and administrative enforcement actions triggered by the United States Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP). In addition to preparing affirmative action programs for all types of industries, Kelly also advises clients on affirmative action matters and preventative strategies.
