Courtney B. Amelung

• Won summary judgment for an insurance company on an employee’s lawsuit alleging discrimination, constructive discharge, hostile work environment, and retaliation. The federal judge agreed that there had been no violation of any law and that the employee’s concerns were simply normal workplace grievances.
• Won dismissal of a federal lawsuit against a hospital asserting failure to promote and retaliation claims under Title VII. The court concluded that the employee’s conclusory allegation that she was more qualified than a male co-worker without a disability, who ultimately obtained the promotion, was insufficient to show that her application was rejected for unlawful reasons. Additionally, the court concluded that the 7-month gap between the employee’s filing of a charge of discrimination against the hospital and her subsequent denial of the promotion negated any inference that the hospital retaliated against her for filing that charge.
• Won a complete defense verdict following a five-day federal court jury trial on a former nursing director’s claim of race and national origin discrimination against her employer. The employer was able to demonstrate that the employee was legitimately disciplined for documented performance issues.
• Won a complete defense verdict for a healthcare client and one of its prior long-term care facilities following a four-day jury trial in federal court. The lawsuit was brought by a former employee of the long-term care facility who asserted claims of race discrimination and retaliation under federal and state law, as well as retaliation and interference under the Family and Medical Leave Act.
• Won a partial motion to dismiss on behalf of a healthcare employer. An employee claimed retaliation, ostensibly for opposing race discrimination. As the federal district court found, the employee did not allege any discriminatory employment practices by the employer.
• Won a motion to dismiss several claims against a healthcare employer in a federal lawsuit brought by a former employee by successfully arguing that the employee had failed to meet the administrative prerequisite for his disability claims since his EEOC charge alleged only age discrimination.
• Won a motion to dismiss on behalf of a non-profit continuing care retirement facility in Maryland state court. The former employee failed to state a claim that he had been denied a reasonable accommodation, as he had been granted a 3-month leave of absence for his disability that permitted him to return to work and perform the essential functions of his job.
• Won a motion to dismiss in federal court on behalf of a medical center. The court found that it lacked the jurisdiction to hear the former employee’s claims of discrimination, wrongful termination, and retaliation.
