Isabel Rybalnik brings over 20 years of experience in immigration law, focusing on business immigration. Isabel has worked extensively on both immigrant and non-immigrant matters, filed with USCIS as well as consular applications.
Isabel is well-versed in PERM-based EB-2 and EB-3 I-140 petitions, and I-485 applications for adjustment of status. Attorney Rybalnik has worked with companies of various sizes, including start-ups as well as Fortune 500 companies in industries ranging from IT consulting, e-commerce, e-sports, software development, healthcare and education, as well as others.
She has analyzed complex issues such as demonstrating a company’s ability to pay the offered wage, and demonstrating a position’s business and degree requirements. She has helped individuals with issues of inadmissibility, such as consequences of criminal activity, Communist party membership, prior lapses in immigration status, and periods of unauthorized employment. She has represented companies facing PERM audits and site visits from USCIS and DHS, and has assisted companies with responses to ICE workforce inspections. Isabel Rybalnik has also assisted corporations with self-auditing their I-9 records to ensure compliance with regulations, including working with E-Verify.
Isabel has also worked on non-immigrant matters, including H-1B, H-1B1, L-1, TN, and E-3 cases, including responding to requests for evidence, notices of intent to deny and filing motions to re-open. She has also assisted foreign nationals in securing non-immigrant visas from US consulates, including administrative processing delays.
She also has experience with family-based matters such as I-130 immigrant petitions for spouses, parents, children and siblings, as well as accompanying I-485 applications and I-751 petitions to remove conditions on lawful permanent residence. Isabel has assisted clients with preparing for and attending USCIS interviews.
Isabel has represented clients with complex issues such as waivers of the J-1 2-year residency requirement and waivers due to unlawful presence or criminal issues. She has also assisted clients with nuances of applying for US citizenship, such as evidencing good moral character and continuous presence in the U.S. She speaks Russian and French
