Jacqueline R. Barrett

Ms. Barrett is a Shareholder in Ogletree Deakins’ Philadelphia office. Ms. Barrett represents employers in a broad spectrum of matters, however, she focuses her practice on litigating discrimination, harassment, retaliation, whistleblowing, and wage and hour disputes. Ms. Barrett also has significant experience prosecuting and defending claims related to restrictive covenants and trade secret laws and representing clients in wage and hour audits.

In addition to litigating, Ms. Barrett regularly counsels employers, conducts harassment and discrimination trainings and investigations, and evaluates workplace policies for compliance with state and federal law.

Ms. Barrett practices before state and federal courts as well as various administrative agencies, including but not limited to the Equal Employment Opportunity Commission, the Pennsylvania Human Rights Commission, and the Department of Labor.

  • Defeated class certification in FLSA action on behalf of national retail chain.
  • Obtained voluntary withdrawal of class and collective wage claims in multiple matters.
  • Lead attorney in employment discrimination and wage and hour arbitrations.
  • Counsels employers on a national basis in employment, personnel, and human resources matters such as hiring and discharge, reductions in force, wage and hour compliance, family and medical leave issues, employment separation agreement, and creation and implementation of workplace policies.
  • Secured summary judgment on behalf of large privately held company where plaintiff claimed national origin discrimination.
  • Successfully first-chaired arbitration brought by lawyer against his former law firm in which lawyer claimed wages owed to him, resulting in dismissal of claims.
  • Achieved very favorable settlement of state-wide class action for overtime pay at a fraction of estimated damages.
  • Secured a no-cause finding by the EEOC in a class action age discrimination investigation.
  • Led appellate briefing for disability discrimination and retaliation claim brought by former employee.
  • Defended clients in multiple bench and jury trials in state and federal court, including trials for breach of employment contract, discrimination, and retaliation claims.
