Kenneth J. Kleppel

For more than two decades, Ken has helped employers navigate challenging legal and risk management issues. From the rigors of litigation through day-to-day counseling, Ken strives to achieve pragmatic results for his clients.

Ken regularly represents employers before federal and state courts, the Equal Employment Opportunity Commission, the National Labor Relations Board, the United States Department of Labor, the Indiana Civil Rights Commission, and the Indiana Department of Labor. He has handled all types of labor and employment claims in these venues, from wrongful termination to union organizing to employment-related torts to non-compete and trade secret litigation.

Ken’s extensive experience in counseling employers helps him in the courtroom or in working with his clients to avoid it.  Ken regularly advises employers on a wide range of labor and employment matters, including discrimination, harassment, retaliation, disability accommodations, FMLA, wage and hour, occupational health and safety, and reduction in force, among others. Likewise, Ken counsels employers on proactive policy writing and handbook development, and best practices to avoid litigation. Ken also conducts workplace investigations and addresses post-investigation claims.

Related to his work in labor and employment law, Ken advises employers on civil rights issues, including accessibility barriers, housing discrimination, and Constitutional claims. He also counsels employers on general corporate matters, facilitating growth of their businesses through contract preparation and review. 

Prior to joining Ogletree Deakins, Ken practiced labor and employment law at regional law firms in Indianapolis, Indiana, and Cleveland, Ohio, and worked in Law, Policy and Governance at the NCAA.
