• Assists and advises companies on the preparation and review of all kind of employment related documents, such as agreements, internal work regulations, work policies, and codes of conduct.
• Provides legal advice in connection with day-to-day operations and employment matters with a focus on commercial and human resources impact.
• Assists and advises companies on how to conduct matters before the IMSS, from obtaining the registry before said authority, through issuing and conducting disability/leave certificates, up to litigating tax credits.
• Assists and advises companies in order to ensure compliance with Mexican Official Standards (Normas Oficiales Mexicanas or NOMs for its acronym in Spanish) related to employment relations and safety and health in the workplace.
• Assists and advises companies on employment termination processes, from determining appropriate courses of action, through calculating estimated amounts for severance and preparing required documents up to the execution and formalization of said processes.
• Assists and advises companies on conducting Administrative Procedures before the Labor Ministry, such as ordinary and extraordinary inspections.
• Assists and advises companies on alimony claims.
• Assists and advises companies on outsourcing compliance.
• Has experience conducting workplace investigations.
• Has experience in litigation processes before the Federal and Local Labor Courts.
• Has experience in Amparo appeals filed before Circuit Collegiate Courts, District Courts and Mexico’s Supreme Court of Justice,
• Participated in due diligence processes to determine if companies comply with Mexican employer obligations.
• Has experience in labor matters, such as collective bargaining agreements’ negotiation, preparation, annual and biannual renewals.
