Tevis Marshall is a founding member of the firm’s Richmond office and focuses his practice on all aspects of traditional employment law. He regularly counsels employers on a broad range of workplace issues, including regulatory compliance, personnel policies, hiring, disciplining, terminating, reasonable accommodations, FMLA leave and workplace investigations. He has also assisted clients in managing onsite investigations from the EEOC and the U.S. Department of Labor.

In addition to advising employers on workplace issues, Tevis has litigated cases on a wide range of topics, including discrimination, harassment, retaliation, Title VII, the Americans with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), overtime and wage violations under the Fair Labor Standards Act (FLSA), the Family Medical Leave Act (FMLA), the Employee Retirement Income Security Act of 1974 (ERISA), non-compete agreements, wrongful termination and other general employment matters. Tevis has handled matters before the EEOC, the Department of Labor, the Financial Industry Regulatory Authority (FINRA) and numerous state and federal courts.

Tevis is also committed to public service. Since 2009, he has served as the President of the Board of Directors for Human Resources, Inc., a non-profit organization that offers a wide range of substance abuse treatment services for individuals suffering from opioid addiction. Tevis also works to advance the knowledge of employers and human resources professionals with respect to state and federal employment laws. He is an active member of the Society for Human Resources Management (SHRM) and frequently lectures on employment law topics throughout Virginia.

  • Obtained dismissal of former employee’s claims for race and gender discrimination, hostile work environment, retaliation and related state law claims brought against national security services company (E.D. Va. 2017)
  • Obtained dismissal of claims for breach of employment agreement, negligence and fraud brought by former employee against professional staffing firm, affirmed by the Fourth Circuit Court of Appeals (E.D. Va. 2016)
  • Prevailed at trial on claims brought against national retailer for violations of the Americans with Disabilities Act (W.D. Va. 2015)
  • Successfully defended and resolved claims asserting violations of FMLA against manufacturing company (W.D. Va. 2014)
  • Successfully defended and resolved claims for tortious interference and breach of non-compete agreement filed against national professional staffing company (E.D. Va. 2014)
  • Obtained dismissal of claims brought pursuant to Labor Management Relations Act of 1947 (LMRA) against international manufacturer, affirmed by the Fourth Circuit Court of Appeals (E.D. Va. 2014)
  • Successfully defended and resolved claims against municipality brought by eight plaintiffs alleging racial discrimination, hostile work environment and retaliation (E.D. Va. 2013)
  • Obtained dismissal of plaintiff’s ERISA claim for long-term disability benefits (E.D. Va. 2013)
  • Successfully defended and resolved claims of unlawful discrimination and retaliation based on race against national bank (E.D. Va. 2011)
  • Obtained summary judgment for insurer in ERISA case seeking long-term disability benefits (W.D. Va. 2010)
  • Obtained dismissal of breach of employment contract claim, affirmed by Supreme Court of Alabama (Sup. Ct. of Ala. 2009)
  • Obtained dismissal of claims for retirement benefits brought under ERISA (W.D. Va. 2008)
  • Obtained summary judgment on claim for accidental death and dismemberment benefits brought under ERISA (W.D. Va. 2008)
