Veronica Yu Welsh

• Won summary judgment on behalf of a large corporation where the plaintiff failed to file a charge of discrimination with the EEOC against the corporation and unsuccessfully argued that the corporation was substantially identical to the entity named in his EEOC charge or a joint employer.
• Partially won summary judgment on behalf of a media company in a 13-count lawsuit, which resulted in the dismissal of the former employee’s race, national origin, sex, religion, and disability discrimination claims and retaliation claims under the D.C. Human Rights Act. The Court held that the media company had a legitimate non-discriminatory reason for the employment actions taken against the former employee, and the former employee failed to establish that the employment actions taken by the media company were causally related to any alleged protected activity.
• Successfully obtained dismissal of a discrimination lawsuit for a large public school system. The federal court agreed that the plaintiff had failed to file a timely charge of discrimination with the EEOC or the Maryland Commission on Civil Rights.
• Obtained significant sanctions against a plaintiff and her attorney in a case in the D.C. Superior Court. The defendant discovered that the plaintiff had fabricated evidence to support her wage claim. Still, the plaintiff and her counsel (in the words of the court) “tripled down” on the supposed authenticity of the evidence and then tried to use the fraudulent evidence to barter a deal with the company.
• Won a motion to dismiss in federal district court on behalf of a healthcare employer. The judge found that the plaintiff had failed to allege facts that established a plausible claim for a hostile work environment or unlawful retaliation.
• Won a motion to dismiss on behalf of a healthcare employer. The federal judge was found unlawful. An Equal Employment Opportunity Commission regulation permitted the EEOC to issue a Notice of Right to Sue to the plaintiff before 180 days had passed after the plaintiff’s filing of the required charge of discrimination. Consequently, the plaintiff’s suit was premature.
• Won summary judgment for a healthcare employer. The federal judge found that the former employee failed to establish discrimination claims based on her national origin and race and that she had no evidence to rebut the employer’s legitimate, non-discriminatory, non-retaliatory decision to terminate her and deny her internal appeal.
• Obtained a defense verdict on behalf of a non-profit organization in the District Court of Baltimore County. Judgment was entered in favor of Veronica’s client as to all counts, including two separate negligence claims.
• Won a motion to dismiss a private medical practice that was being sued for discrimination. The court agreed that the plaintiff had failed to state a claim.
