Andrew B. Levin

Shareholder   |   Phoenix

Andy is a strategic advisor who practices in both Arizona and California, offering a single point of contact for clients with operations in both states. Andy partners with in-house counsel and executive leadership to inform strategic decisions throughout the lifecycle of employment disputes, whether that means aggressively litigating claims or strategically negotiating settlement options to achieve optimal outcomes. His practical, results-oriented mindset focuses on delivering the most effective solution for each scenario.

Andy possesses deep subject matter experience litigating wage and hour class actions and California PAGA representative actions across a wide range of industries, including agriculture, automotive, financial services, manufacturing, pharmaceutical, retail, and technology. He defends employers of all sizes in wage and hour class and PAGA cases, from the largest companies in the world to small, family-run businesses. Given the significant stakes involved, Andy regularly engages directly with C-suite leadership to develop and execute litigation strategy. When aggressive litigation has been the chosen strategy, Andy has obtained early dismissal of putative class action and PAGA cases as well as successfully defended and enforced employer arbitration agreements to negate the risk of a class action. When the directive has been strategic resolution, Andy has secured highly valuable settlements for companies, including those in the midst of major corporate transitions, resolving matters involving thousands of class members and hundreds of millions of dollars in potential exposure.

Beyond class actions, Andy defends employers in single-plaintiff employment matters in Arizona and California state and federal courts, including harassment, discrimination, and retaliation claims brought under the California Fair Employment and Housing Act and Title VII, as well as high-stakes restrictive covenant disputes. Successful results include obtaining summary judgment and dismissals at the pleading stage.

Outside the courtroom, Andy leads high-level executive internal investigations and third-party investigations, including in the sports and entertainment industries, identifying and resolving areas of liability efficiently and practically. As a trusted counselor, Andy provides day-to-day advice to employers on employment law compliance, including restrictive covenant agreements, severance agreements, wage statements, independent contractor status, and meal and rest periods. He regularly conducts on-site trainings for employers on preventing and addressing harassment and retaliation in the workplace.

A frequent guest lecturer, Andy teaches undergraduate and MBA students at Arizona State University’s W.P. Carey School of Business about employment law, providing practical insights and best practices they can implement as they become business owners and corporate executives.

Andy has been named to Best Lawyers in America “Ones to Watch” list for Labor and Employment in 2022, 2023, and 2024.

Prior to joining Ogletree Deakins, Andy was an associate at the international law firm Cadwalader, Wickersham & Taft LLP in Washington, D.C., where he represented clients in significant commercial litigation and regulatory matters in state and federal courts and before federal agencies, and advised corporations on antitrust considerations in multibillion-dollar M&A transactions.

Andy is a Phoenix native and an alumnus of Brophy College Preparatory and is an avid college basketball and NBA fan.
