Evan L. Conder

• Won a partial motion to dismiss in federal court on behalf of a senior living facility in a case alleging religious discrimination, disability discrimination under the ADA, and genetic information discrimination under GINA arising from a COVID-19 vaccine mandate. The court agreed that the employee had failed to file the required charge of discrimination with the EEOC as to her claims of discrimination on the basis of her genetic information and disability, as well as her retaliation claim. Although she had filed a charge alleging failure to provide a religious accommodation, her other claims were not sufficiently related to that claim to meet the charge filing prerequisite.
• Successfully obtained summary judgment for a non-profit. At issue was the regular rate of pay for employees working in different positions. The organization compensated the plaintiffs’ work in each position at different rates, which the plaintiffs argued was a way to circumvent paying employees correctly; however, the federal court found the organization’s method of calculating pay to be lawful.
• Won a motion to dismiss defamation claims brought by two former company employees. The federal court found that the company’s internal communications about possible fraud by the employees were lawful.
• Obtained dismissal of a discrimination lawsuit after successfully moving the court for sanctions against the plaintiff for discovery abuses. The court granted the motion for sanctions and ordered the plaintiff to bear the costs incurred in connection with depositions and the discovery dispute.
• Won summary judgment on a religious accommodation claim on behalf of a healthcare provider client. The federal court found that accommodating the employee’s religious exemption to the COVID-19 vaccine would have imposed an undue hardship on the employer due to the health and safety risks in a healthcare setting, the nature of the employee’s patient-facing role, and the vulnerability of the patient population served by the facility.
• Obtained dismissal of all claims brought against an individual defendant, a medical residency program director, in a lawsuit by a former medical resident alleging breach of contract, breach of the covenant of good faith and fair dealing, promissory estoppel, breach of academic procedural rights, and violation of medical ethics. The court agreed that the individual defendant was not a party to the resident’s employment agreement and that the plaintiff’s claims failed as a matter of law.
