Elbert Ortiz is a persuasive, compelling, and determined advocate who gets results. His litigation experience has earned him a reputation for zealous representation and tough negotiation. Elbert’s employment-based practice will focus on advice and counsel on personnel matters and the defense of employment law claims before administrative agencies and in federal and state court. He regularly advises and trains managers and HR professionals regarding compliance with state and federal employment laws as well as workplace issues, including harassment prevention, family and medical leave, and reasonable accommodation.
Elbert defends employers against single and multi-plaintiff lawsuits and arbitrations involving claims of harassment and discrimination on the basis of protected classes, workers’ compensation retaliation claims, FMLA interference and retaliation claims, and common law claims for wrongful discharge, negligent hiring. Elbert also has experience representing employers in disputes arising from covenants not to compete, non-solicitation agreements, and covenants prohibiting the disclosure of trade secrets and confidential information. In addition to his first-chair litigation and arbitration experience, Elbert assists employers in responding to complaints submitted to various state and federal agencies, including the Texas Workforce Commission, the Equal Employment Opportunity Commission, and the Department of Labor.
