Phillip Russell is a board-certified OSHA and employment lawyer with over 30 years of experience helping employers navigate workplace safety and employment law issues. Known for his practical, business-oriented approach, Phillip is a trusted advisor to companies facing complex compliance challenges, crises, and high-stakes litigation.

Phillip has received national recognition for his client service. OSHA Inspections, Citations, and Litigation. Phillip has represented employers in hundreds of OSHA inspections, including over 225 workplace fatalities across various industries, such as construction, manufacturing, and logistics. His focus is clear: protect people and minimize business risk. When OSHA arrives, Phillip brings calm to chaos and clarity to uncertainty, assisting clients in managing investigations and avoiding costly citations. OSHA Preparedness and Training. Phillip doesn’t just respond when OSHA shows up—he helps clients prepare well in advance of an inspection. Phillip has delivered these programs across entire organizations for national companies and on major construction and manufacturing projects, giving clients confidence and control when OSHA arrives.

OSHA Regulatory Advocacy and Thought Leadership. Phillip advises national employers and industry associations on OSHA policy and regulatory priorities. He was a leading voice against OSHA’s COVID Emergency Temporary Standard, which the U.S. Supreme Court ultimately struck down. A recognized thought leader, Phillip hosts the firm’s OSHA podcast Dirty Steel-Toe Boots, edits the ABA’s leading OSHA treatise twice, and regularly speaks and writes for industry groups.

Employment Litigation and Strategic Advice. Phillip also acts as lead strategic counsel in high-stakes employment litigation and offers labor and employment guidance to clients. His approach integrates legal knowledge with business insight to deliver practical, strategic solutions.

Personal. Phillip and his wife, Liz, have three children and co-founded Autism Inspired Academy, a nonprofit school serving 155 students on the autism spectrum. Experience

Phillip is a go-to lawyer when OSHA conducts investigations after a fatality or other major incident. He has managed OSHA issues across diverse industries, including transportation infrastructure construction, commercial electrical contracting, manufacturing, and logistics. Phillip also advises clients on enterprise-wide OSHA preparedness programs, helping them develop inspection protocols and train safety, legal, and operations teams.

Representative OSHA Matters

OSHA Withdraws Citation Following Fatal Fall – A subcontractor’s employee fell through a steel grating floor on a major erection project. Despite barricades and tie-off requirements, OSHA cited the client for a serious violation. Phillip contested the citation before the Occupational Safety and Health Review Commission, and OSHA eventually withdrew it completely.
Fatal Struck-by Incident Results in No OSHA Citation – During a major bridge replacement project, a worker was fatally struck by a dump truck. Phillip deployed resources immediately, managed OSHA’s six-month investigation, and demonstrated the client’s robust safety program. OSHA issued no citation, preserving the client’s reputation and avoiding millions in potential losses.
Fatal trenching accident results in no OSHA citation – after an 8-foot trench collapse killed an employee, Phillip collaborated with the client’s leadership and safety teams to prepare for OSHA’s inspection. By demonstrating comprehensive safety measures and a lack of supervisory knowledge, OSHA closed its file without issuing a citation.
Fatal Fall Accident Leads to Minimal Citation – A worker fell during a bridge demolition project. Phillip negotiated a settlement that avoided willful violations, lowering penalties and reducing liability risks.

Representative Employment Matters

State Court Summary Judgment Victory – On behalf of a major international client, Phillip and his team achieved summary judgment in a discrimination and harassment case after four years of litigation and extensive discovery—an uncommon outcome in state court.
Injunction Avoided in Restrictive Covenant Litigation – Phillip and his team helped a national technology industry client avoid an injunction sought by a competitor after the client hired away an executive.
