Shir Fulga

Associate   |   Toronto

Shir is a responsive and practical lawyer at Ogletree Deakins’ Toronto office, bringing over seven years of experience in labour and employment law.

While Shir advises clients across all areas of human resource law, she possesses particularly deep expertise in labour relations. Shir delivers comprehensive training to leadership at all levels in this area, covering topics such as fostering positive employee relations, understanding and responding to union organizing campaigns, navigating the unionization process, and managing effectively in a unionized environment. Shir’s expertise spans all Canadian provinces, with significant depth in Ontario and British Columbia.

In addition to her specialization in labour relations matters, Shir provides timely and effective guidance on a wide range of human resources issues. These include advice on the legal considerations of hiring employees in Canada, reductions in force, employee and contractor misclassification issues, and advice and representation in wrongful dismissal disputes.

Shir’s representative litigation experience includes successfully arguing before the Ontario Labour Relations Board that a union’s bargaining unit description was not appropriate, resulting in the board dismissing the union’s application for certification. Additionally, Shir successfully argued against a union application for access rights for the purpose of campaigning at a client’s site, also before the Ontario Labour Relations Board. Shir regularly represents clients in labour arbitrations and has successfully argued collective agreement interpretation disputes and discharge cases.

In addition to her litigation successes, Shir has efficiently negotiated the resolution of numerous wrongful dismissal matters through skillful negotiations, a deep understanding of the law, and a keen awareness of her clients’ goals and needs.

Shir’s client service approach, characterized by swift, efficient, and tailored advice, has earned her a reputation as a trusted advisor to employers navigating the dynamic landscape of Canadian labour and employment law. Shir’s dedication to her clients and her ability to provide practical, business-focused solutions make her a partner of choice in managing workplace challenges.
