Noel Hernandez is a shareholder in Ogletree’s Las Vegas office. She represents employers of various sizes in state and federal court litigation and administrative proceedings across all aspects of labor and employment law, including wrongful termination, discrimination, wage and hour, breach of contract, harassment, retaliation, and employee classification disputes.

Noel works with clients on matters at the pre-litigation stage to facilitate a favorable resolution before a lawsuit is initiated. Additionally, she works with employers to draft tailored employee handbooks and implement best practices in workplace policies.

Noel is a member of Ogletree Deakins’ Occupational Safety and Health (OSH) practice, where she assists employers in various industries with the effective handling of OSHA inspections and safety whistleblower complaints, negotiates and resolves OSHA citations, litigates OSHA citations, and advises and counsels clients to ensure OSHA compliance. Her OSHA practice spans the U.S. West Coast, including Nevada, Washington, Oregon, Utah, Arizona, New Mexico, and Hawaii.

Noel’s practice also focuses on wage and hour claims, ranging from class actions involving thousands of putative class members, to representative actions under the Private Attorneys General Act (PAGA), to single plaintiff arbitrations. These cases involve a broad spectrum of wage and hour claims, including alleged violations of minimum wage, overtime, prevailing wage, regular rate, meal and rest break requirements, business expenses, and wage statement statutes.

Noel enjoys appellate advocacy and has successfully argued before the U.S. Court of Appeals for the Ninth Circuit in a highly contested case involving discrimination and retaliation claims.

Prior to joining Ogletree Deakins, Noel completed a judicial clerkship for the Honorable Timothy C. Williams in the Eighth Judicial District Court, where she helped draft legal opinions, analyze summary judgment motions, and brief upcoming issues for trial.
