Michael Rubin

Clients turn to Michael for comprehensive counsel on all aspects of occupational safety and health law. He advises and represents employers across multiple industries and throughout the United States in OSHA inspections, investigations, and enforcement actions. He also assists employers with developing, implementing, and auditing workplace safety programs and provides practical guidance on compliance and risk-management strategies.

Michael is known for his strategic, results-driven approach and for guiding employers through complex and high-stakes OSHA matters. He has led numerous workplace accident investigations—mobilizing and overseeing teams to manage serious incidents and fatalities—and represents employers before, during, and after the OSHA inspection process. Michael routinely contests citations on behalf of employers and negotiates for their withdrawal or other form of resolution.

With more than 20 years of litigation experience, Michael has taken multiple OSHA matters to trial and regularly litigates before the Occupational Safety and Health Review Commission (OSHRC) and in State Plan jurisdictions. He draws on extensive experience gained while litigating construction accident cases in New York City during the first half of his career. An AV-rated attorney, adversaries have described Michael as a “worthy adversary,” “aggressive advocate,” and “highly skilled.”

Michael has handled OSHA matters in 40 states, including Alabama, Arizona, California, Colorado, Connecticut, Delaware, Florida, Georgia, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Louisiana, Maine, Massachusetts, Michigan, Minnesota, Missouri, Montana, Nebraska, Nevada, New Jersey, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia, Washington, West Virginia, and Wisconsin.

A recognized thought leader in workplace safety and OSHA compliance, Michael has delivered well over 100 presentations nationwide. He frequently speaks at industry conferences hosted by the American Society of Safety Professionals (ASSP), Associated General Contractors (AGC), and Specialized Carriers & Rigging Association (SC&RA), and serves as a guest lecturer in Columbia University’s Construction Management Master’s Program.
