Kathleen D. Weron is an employment attorney with deep experience advising and defending employers on workplace safety, labor relations, and complex employment matters. She works closely with clients—particularly in Utah’s growing manufacturing sector—to navigate regulatory compliance, protect business interests, and manage risk in a rapidly evolving legal landscape.

Kathleen has extensive experience in occupational safety and health, regularly representing employers during Occupational Safety and Health Administration (OSHA) and Utah Occupational Safety and Health (UOSH) inspections, investigations, and enforcement actions. She conducts privileged workplace safety audits and helps businesses develop and implement compliance strategies that align with operational goals. Her approach blends legal precision with practical insight into industry-specific challenges.

She also counsels employers on protecting confidential business information and enforcing restrictive covenants. Kathleen drafts and negotiates noncompete, nonsolicitation, and confidentiality agreements, and represents clients in litigation involving trade secrets, misappropriation, and unfair competition. She frequently advises employers on hiring, departures, and workforce changes, helping them protect proprietary information, enforce restrictive covenants, and minimize legal exposure.

Kathleen maintains an active traditional labor practice and regularly advises unionized employers on all aspects of labor relations. She has served as lead counsel in collective bargaining negotiations and has extensive experience drafting and interpreting collective bargaining agreements. Kathleen represents employers in labor arbitrations and grievance proceedings and provides day-to-day counsel on contract administration, discipline, and workforce management. She also advises management teams on union avoidance strategies, conducts supervisor training, and supports employers during organizing campaigns and representation proceedings. She works closely with leadership to proactively resolve labor issues and implement strategies that support long-term workforce stability.

She brings broad experience in employment litigation and administrative proceedings, regularly representing employers in matters involving discrimination, retaliation, wage and hour compliance, the Family and Medical Leave Act (FMLA) and Americans with Disabilities Act (ADA) accommodations, and reductions in force, including Worker Adjustment and Retraining Notification (WARN) Act compliance. She frequently guides employers through restructurings and associated risk management. In addition to litigation, Kathleen provides practical, day-to-day counsel to ensure workplace decisions align with both business objectives and legal obligations. She collaborates with HR teams and in-house counsel to develop tailored employment policies, handbooks, and agreements.

Kathleen has represented employers before federal and state administrative agencies, including the Equal Employment Opportunity Commission (EEOC), OSHA/UOSH, the U.S. Department of Labor, the U.S. Department of Justice, and the Utah Labor Commission. Her litigation experience encompasses discrimination and retaliation claims, whistleblower matters, wage and hour disputes, and restrictive covenant enforcement. With experience in both trial and appellate courts, she offers strategic guidance throughout the life cycle of a dispute—from agency proceedings and litigation through appeals, including before the Fifth and Tenth Circuits and the Utah Supreme Court.

She also conducts internal investigations, compliance audits, and workplace training across a wide range of industries. Kathleen is known for her ability to translate complex legal requirements into clear, actionable guidance that supports compliance, business continuity, and strong workplace practices.

Kathleen has been regularly recognized in The Best Lawyers in America® for Labor and Employment Law, including being named “Lawyer of the Year” in Salt Lake City in 2016 and 2023 for Employment Law – Management, and in 2017 for Litigation – Labor and Employment. She was recognized in Chambers USA® for over a decade, where clients described her as “tremendously well-versed in the law” with “considerable expertise” and a strong understanding of “the dynamic of employment relationships.” From 2004 to 2023, she was voted by her peers as one of Utah’s “Legal Elite” in Labor and Employment Law by Utah Business magazine.

She serves on the Board of Advisors for the Economic Development Corporation of Utah and its Business Development Subcommittee. Kathleen is a graduate of the University of Utah’s S.J. Quinney College of Law, where she was a Leary Scholar and served on the Utah Law Review. She clerked for the Honorable Ewing Werlein, Jr. of the U.S. District Court for the Southern District of Texas.
