R. Scott DeLuca

Of Counsel   |   Buffalo

R. Scott DeLuca is of counsel at Ogletree Deakins and is a seasoned labor and employment law attorney. Scott’s practice focuses on guiding employers through the maze of laws and regulations impacting the employer-employee relationship, and helping employers emerge stronger and more compliant on the other side. In addition, Scott has represented myriad employers in administrative proceedings and litigated matters with a focus on employment-related claims.

Scott has over twenty-five years of experience handling matters relating to employment discrimination, wage payment requirements under Federal and State law, employee benefits issues, issues under the Family & Medical Leave Act, disability and religious accommodations under Federal and State law, and other issues impacting the employer-employee relationship. These experiences require a blend of legal knowledge and a deep understanding of workplace dynamics.

With this in mind, Scott has helped employers create policies that not only enhance workplace relations but also fortify them against legal challenges. Scott concentrates on building bridges between legal requirements and what an employer needs to flourish and succeed. Scott also seeks solutions that protect and advance the employer’s interests. Whether through revising contracts to reduce risks, leading training sessions to ensure everyone is knowledgeable of the latest legal requirements, or counseling employers on the day-to-day issues that arise in labor and employment law, Scott always strives to add value to his representation and to ensure peace of mind.

Of course, not every issue can be resolved and litigation is a constant threat on the landscape. Scott has represented employers in Federal and State Courts around the United States with professionalism and zeal. Similarly, Scott has represented employers in proceedings before the U.S. Equal Employment Opportunity Commission, U.S. Department of Labor, the National Labor Relations Board, the U.S. Occupational Safety and Health Administration, the N.Y.S. Division of Human Rights, the N.Y.S. Department of Labor, and the N.Y.S. Public Employment Relations Board. Scott’s keys to handling litigation and administrative proceedings are his strategic focus and determined effort toward achieving the result sought by the client.

Scott’s approach is deliberate and client-focused, while forging lasting relationships built on trust, professionalism, excellence, and mutual respect. Scott’s motivation is not just on legal victories; he wants to contribute to a work environment that protects the employer’s interests and is legally compliant, and that is fair, safe, and productive for everyone.

Navigating the employer-employee relationship in the current realm of labor and employment law is very challenging. Scott shares insights, offers guidance, and assists employers in creating a workplace that is compliant, thriving, and inviting.
