As discussed in the December 2010 issue of the New Jersey eAuthority, the New York Department of Labor’s Wage Order for the Hospitality (and Restaurant) Industry went into effect on January 1, 2011. The Department of Labor has recently made available through its website a new required poster concerning the implementation period for the wage order, and also has made available summaries of the major provisions of the wage order (click here and here). Employers in the hospitality and restaurant industries should immediately post this new poster, and must take steps to ensure compliance with each of the various provisions of the wage order by the implementation date of March 1, 2011 (or their next regularly scheduled pay day following March 1, 2011), including retroactive payment of wages to January 1, 2011.
