Even under this allegedly business-friendly administration, the Office of Federal Contract Compliance Programs (OFCCP) continues to advance an aggressive enforcement agenda against federal contractors and subcontractors, with plans to audit 3,500 establishments in Fiscal Year 2019. While OFCCP will continue to focus on hiring and compensation discrimination, it is expanding its focus on disability compliance and has proposed significant changes to what covered contractors must provide in initial audit submissions. In an unprecedented measure to uncover noncompliance, OFCCP will require all covered contractors to verify affirmative action program compliance. This briefing will examine the fast-moving world of affirmative action compliance, discuss noteworthy trends, and provide best practices in this nuanced area of law.
