Many employers continue to see the value in requiring employees to sign employment arbitration agreements, thereby avoiding the cost and risk of jury trials. However, legal standards relating to the viability of arbitration agreements continue to evolve and New Jersey courts have recently issued several significant decisions affecting the enforceability of employer-promulgated arbitration agreements and programs. Courts and the National Labor Relations Board also continue to weigh in on these issues, including the viability of class action waivers.
