Continuing a recent trend, Massachusetts has become the latest state to implement major changes to its equal pay laws. The new reforms significantly broaden existing law by establishing a violation for pay differentials between men and women for “comparable work” and by prohibiting employers from asking prospective hires about their salary histories with prior employers (unless authorized in writing by an employee after an offer has been made). As such, Massachusetts employers need to be mindful of these new litigation risks and consider taking proactive steps to address any potential pay disparities.
