This year, the federal Occupational Safety and Health Administration (OSHA) and accompanying state agencies have been inundated with concerns and complaints relating to COVID-19. In some cases, the information provided in an employer’s response to an OSHA inquiry and the agency’s conclusions may be discoverable and used in civil litigation later.
