Executive Order (EO) 14173 requires federal contractors and recipients of federal funds to certify their compliance with all federal anti-discrimination laws and that they are not operating any programs that promote diversity, equity, and inclusion (DEI) that conflict with these laws. In this webinar, the speakers will provide an overview of the current certification requirements and the risks associated with noncompliance, including potential violations of the False Claims Act and the penalties that may result. The speakers will also discuss strategies employers can use to establish a good faith belief of compliance when making the required certifications, including the possibility of an affirmative defense and potential safe harbor.Â
