On June 5, 2025, the Supreme Court of the United States unanimously ruled that majority-group employees do not have to meet a higher evidentiary standard to prove workplace discrimination, potentially opening the door for more lawsuits from majority-group members. This decision rejects the Sixth Circuit Court of Appeals’ “background circumstances” rule and aligns with the U.S. Equal Employment Opportunity Commission’s guidance that discrimination is discrimination, and so-called “reverse” discrimination is not a different or unique claim.
