Paul D. Burgin

• Assisted in winning a motion to dismiss in federal court on behalf of a skilled nursing facility. The plaintiffs had alleged that the client was liable as a successor entity for its predecessor’s alleged delinquent employee fringe benefit contributions. The court agreed that the plaintiffs did not allege sufficient facts to establish that the client was on notice of the liability prior to its purchase of its predecessor’s assets.
• Won a partial motion to dismiss in federal court by establishing that the customer and employee non-solicitation provisions in an employee’s restrictive covenants agreement with her former employer were overbroad and, therefore, unenforceable.
• Won summary judgment on behalf of a healthcare organization sued by a former employee alleging religious discrimination in connection with the organization’s COVID-19 vaccination policy.
• Helped obtain a temporary restraining order against a non-profit organization’s former Executive Director who retained improper access to the Organization’s confidential and trade secret information and changed passwords and access credentials to the Organization’s systems and accounts, preventing employees from accessing documents and files necessary to perform their work.
• Won a motion to dismiss a lawsuit filed by a former employee of a health care employer alleging race discrimination and retaliation. The court found that the Complaint was untimely as it was not filed within 90 days after the plaintiff’s receipt of her right to sue letter from the EEOC. Although the plaintiff alleged that it was her attorney’s negligence that led to the late filing, the court did not find her circumstances justified tolling of the statute of limitations.
• Won a motion to dismiss a former employee’s claims of race and age discrimination, as well as retaliation, on behalf of a health system. The court found that the plaintiff had failed to allege any adverse employment action, and that any difference in treatment was not based on race or age.
• Won a motion to dismiss a complaint of religious discrimination filed against an insurance company.
