Zachary Byers helps mine operators and other employers turn MSHA and OSHA challenges into clear, defensible action plans that reduce enforcement risk and keep operations running. He partners with companies in the mining—including cement, sand, stone, and metal—manufacturing, and logistics industries to prepare for inspections, respond to incidents, and resolve citations efficiently, protecting people, production, and reputation.

Drawing on government-side experience at the Federal Mine Safety & Health Review Commission and the Federal Labor Relations Authority, Zach understands how agencies build cases, evaluate violations, and negotiate.  He uses that insight to position clients early, narrow alleged exposures, and pursue outcomes that limit penalties, avoid adverse designations, and reduce collateral consequences.

Zach advises across the full lifecycle of MSHA and other workplace safety matters, including incident response, fatality and accident investigations, discrimination and whistleblower claims under the Mine Act, and contesting citations, including those designated as significant and substantial (S&S) and unwarrantable failures. His practice includes settlement negotiations, hearings before administrative law judges, and appellate briefing. He also provides advice on practical compliance programs and delivers training on MSHA requirements and inspections to equip supervisors and safety teams to manage risk day-to-day.
