The fact that many courts are still closed to the public has not stopped the filing of new employment lawsuits, including litigation with COVID-19-related allegations. This webinar will highlight new theories of liability that are forming the basis of individual actions, class actions, and representative actions under California’s Private Attorneys General Act (PAGA). Topics will include:
- claims related to workplace safety and employees who allege they were infected at work;
- claims related to state and local paid sick leave laws, family and medical leave laws, and leave under the Families First Coronavirus Response Act; claims related to disability discrimination, failure to accommodate, and failure to engage in the interactive process by employees who claim they cannot work, need modified work, or cannot comply with new safety protocols; and
- claims related to alleged wage and hour violations such as “off-the-clock” work for COVID-19 precautions, reporting time pay, and reimbursement claims by employees working from home.
