The California Labor Code contains several exemptions, or carve-outs, for employees covered by a collective bargaining agreement (CBA). These include exemptions for overtime, meal periods, vacation pay requirements, paid sick leave, and several other California wage and hour requirements. These wage and hour requirements are often the source of expensive class action litigation against union and nonunion employers alike.
