Brian Hayes, co-chair of Ogletree Deakins’ Traditional Labor Relations Practice Group, provided analysis for HR Dive on the U.S. Supreme Court’s decision in Trump v. Slaughter, which held that the president may remove heads of independent multimember federal agencies without cause. Hayes said the ruling will likely extend to agencies such as the U.S. Equal Employment Opportunity Commission (EEOC) and National Labor Relations Board (NLRB), and could lead to more rapid shifts in agency policy between presidential administrations, creating added uncertainty for employers.
“If the challenges fail, as now appears likely, the administration’s actions will stand — potentially reshaping these agencies’ direction and priorities for the foreseeable future,” Hayes said.
